Legal

Terms and Conditions

Last Update : Sep 17, 2026

Overview

These terms form a legal agreement between Institute of Business Technology and Engineering FZ-LLC ("IBTE") and the student, including anyone considering enrolment. Accepting an admission offer from IBTE means accepting these conditions. Together with your admission details and IBTE's guidelines, rules, policies, procedures and current prospectus, they define your relationship with IBTE throughout your studies.

IBTE may modify or amend this contract. Changes are posted on the student portal, emailed, or published on the IBTE website, and affected students are informed within a reasonable time. Review these platforms regularly.

Some programs also require you to follow the terms set by qualification providers, professional organisations or third parties, such as NCC Education or Pearson. Details sit in the program information section of the prospectus. Accepting these terms commits you to those conditions as well, and you are then deemed enrolled in the designated IBTE program.

Admission is confirmed once IBTE receives your completed application form, signed terms and conditions, and every document listed in the application checklist, submitted in person or electronically. If documents or payments are not received by the deadline, or you cannot be reached at the email and phone number you provided, IBTE may suspend or cancel your admission. Fees already paid are not refunded in that case.

Fees are billed annually, with monthly instalments available for convenience until the final year. Tuition, service charges, registration fees and related costs are generally non-refundable unless the chief executive officer and IBTE shareholders confirm an exception in writing. Refund criteria sit in clauses 4.3, 5.1 and 5.2.

Fees exclude VAT and third-party charges, such as qualification provider or government fees. You are responsible for paying those promptly once IBTE notifies you they are due.

Admission

1.1

You are responsible for ensuring that every document and piece of information you give IBTE is true and accurate.

1.2

If your application is found to contain incorrect, incomplete or fraudulent information, omits significant information, or leads to a re-assessment of your fee status, IBTE may withdraw or amend your admission, terminate your registration, and take action against whoever provided the documents.

1.3

If you have not met all conditions of admission by the date notified, IBTE may withdraw your admission or defer your application to the next year of entry.

1.4

Fees, registration charges, tuition fees and other service charges are non-refundable:

  • once the student application form is signed and processed to IBTE;
  • once an enrolment number is issued;
  • once fees are paid after the enrolment number is issued;
  • for instalments and pending fees from a previous course.

All fees are calculated excluding VAT.

1.5

IBTE may ask for satisfactory evidence of your qualifications before admission; only documents in Arabic or English are considered. Failure to provide it may end your admission, your registration as a student and this contract.

Conditions of Admission

2.1

Progression on your program and your final award are not guaranteed. Both depend on your examination performance.

2.2

If registration or reactivation fees are not paid on the terms set out in your application form or invoice, you will be withdrawn without further notice. Have funding in place before you apply. Any money paid is offset against the balance owed to IBTE.

2.3

If you pay monthly or quarterly, you still accept liability for the full tuition fee for the whole academic year, covering terms 1, 2 and 3, whether or not you continue your studies.

2.4

IBTE is not liable for decisions taken on an application. Where admission is not confirmed, or wrong or forged documents are found, fees are not refunded. Processing takes up to one year, during which IBTE provides updates.

Fees term

3.1

Fees may be revised under the Tuition Fee Policy and consist of registration fees, tuition fees, examination fees and other charges. Increases take account of inflation, regulator policy and other factors outside IBTE's control.

3.2

You are not matriculated until tuition fees and other charges are paid, instalments are up to date, or satisfactory evidence of payment is produced. At least 90% of the annual, semester or course tuition must be paid for admission to be confirmed. You are personally liable for your tuition fees.

3.3

You are responsible for paying all tuition fees. Payment methods are listed in your letter or email; the IBTE website and the finance office can give more detail.

3.4

IBTE may pursue legal proceedings in relation to non-payment of fees.

Tuition fees

4.1

Definitions:

  • Tuition fees cover access to IBTE's academic programs and teaching, including the curriculum, campus facilities and supporting services.
  • Registration fees secure your place in a program and cover administrative costs such as processing applications and maintaining academic records.
  • Activation fees cover access to the IBTE student portal and the infrastructure, maintenance and security behind it.
4.2

All tuition, registration and other relevant charges are due four weeks before your course starts. IBTE may cancel an instalment arrangement and demand full payment on its final invoice; instalments are a facility to help you cover annual fees, not a change to them.

4.3

Registration fees are separate from tuition, capped at AED 2,000, and are not counted towards the AED 24,000 tuition. They must be settled by the start of your course or admission is revoked. Once paid they are non-refundable.

4.4

Students progress automatically through levels: a level 3 enrollee moves to levels 4 and 5, a level 4 enrollee to level 5. Each level costs AED 24,000, plus an annual AED 2,000 portal activation fee, waived in the first year if registration is paid upfront. Automatic progression stops only by formal signed agreement with IBTE. If you leave without settling fees for the levels you took part in, IBTE may invoice the full outstanding balance.

4.5

Paying tuition upfront before starting your studies reduces the total to AED 20,000.

4.6

AED 24,000 covers one academic year or a single level, for example level 3 only, level 4 only or level 5 only. On enrolment you are liable for that level and any subsequent levels.

4.7

Monthly instalments require written approval from the finance or admissions office. Once approved you are bound to the full AED 24,000 for the level and any subsequent levels, spread across the academic year. Both parties agree that:

  • payments are due upfront at the start of each month;
  • a missed deadline allows IBTE to cancel your admission and stop your studies. Tuition and registration already paid become non-refundable, and a reactivation fee is payable within one month to resume;
  • one month's grace follows the last expected instalment. If payment is not made within it, IBTE may cancel your admission, with no refund of tuition or associated fees;
  • after termination you must settle registration, re-assessment, reactivation and other charges before re-enrolment is considered, within one month of the payment lapse;
  • late payment can cost you the whole academic year or the level you are studying;
  • re-entry after termination is not automatic. Clear all overdue amounts and pay a AED 2,000 re-registration fee within one month of dismissal;
  • on default IBTE may withhold your records from the qualification provider, whether NCC Education or another body, which means no certifications, qualifications or transcripts. Qualification provider fees are separate from IBTE tuition and remain your responsibility;
  • choosing instalments does not reduce your commitment to the full AED 24,000, whether or not you continue your studies. On delayed or missed payments IBTE may take legal action and seek damages for breach.

Fees / Refund

5.1

In special circumstances, where you submit a refund application consistent with IBTE's tuition fee policy and IBTE approves it in writing, tuition fees may be refunded on withdrawal from a program. IBTE may modify its refund policy from time to time without prior notice.

5.2

Contact the Finance Department with questions about fee payments, tuition details or refunds. Submit all original receipts with a statement explaining the reason for non-payment or the refund request. Any refundable amount, after service charge deductions, is collected from the Finance Department.

Other Fees / Charges

6.1

Costs extend beyond tuition, registration and activation fees. Qualification fees set by third-party providers such as NCC Education apply depending on your course, and further charges may arise for course materials, books, courier services, attestation and customised documentation. Contact IBTE admissions or finance, or the qualification provider, for a full breakdown.

6.2

Student visa applications require 70% of your dues upfront or a cheque as guarantee; IBTE does not start the process before that. Third-party costs, including Tecom charges, government visa processing and any unforeseen fees, are your sole responsibility.

6.3

Examination fees are charged separately, from AED 250 to AED 1,000 per subject. The exact amount is set by IBTE according to the nature of the examination, the resources required and associated administrative costs.

6.4

Attendance below the required 80% in a subject or module may require you to retake it the following term, at IBTE's discretion, with an additional charge between AED 5,000 and AED 10,000 depending on the subject. These charges cover the operational cost of re-teaching. Consistently falling below 80% across modules may end your admission entirely.

6.5

You agree to maintain a minimum of 80% attendance across the academic year you are enrolled in. Failing to do so allows IBTE to cancel your admission and require payment for the full academic year.

6.6

IBTE may pursue legal proceedings if you are in debt to IBTE, and may disclose information to credit reference agencies, debt tracing or fraud prevention organisations. Debts are reported to third-party providers and affiliate universities, which may affect references and applications to study abroad.

6.7

IBTE publishes a schedule of charges for individual items. You are obliged to pay these where they apply to your situation or requirements.

Cancellation rights

7.1

If you accept admission remotely, with no direct in-person interaction when you confirm electronically, you relinquish any later legal right to cancel this agreement.

7.2

Cancellation must be notified in writing, either delivered by hand and receipted at the IBTE Student Affairs office, Block 4, Office 102, Dubai Academic City, or emailed to ceo@ibte.me. A designated cancellation form may be used. Cancellation takes effect only once IBTE confirms it in writing, and you remain liable for unpaid tuition and other charges for the full academic year and any levels you registered for.

7.3

You may end the contract before or during your studies with written approval from IBTE. Cancelling after your program has started does not entitle you to a refund of tuition or registration fees, and remaining fees for the current year and registered levels are still due.

Change to student programme

8.1

Under clauses 8.2, 8.3 and 8.4, IBTE may modify its educational program or the anticipated award without requiring your consent.

8.2

IBTE has the authority to:

  • Alter program content by adding, removing or adjusting individual modules to keep pace with academic advancement and relevance.
  • Adjust delivery, including the academic timetable, the location where classes are held, the number of sessions, assessment methods and schedules, and the mode of delivery, switching classes between onsite and online.
  • Discontinue or merge programs where that delivers better educational value through a unified curriculum.

Such decisions may follow events beyond IBTE's control, resource management, continuous academic improvement, legal amendments, or directions from regulators and professional bodies.

8.3

Where changes are not significant, meaning individual elements change but the overall content or method of delivery does not, IBTE communicates them through routine publications such as the latest Degree Regulations and Programmes of Studies. If a particular module matters to you, confirm its availability with IBTE Admissions before accepting your admission.

8.4

If IBTE discontinues your intended program, or alters its content, delivery or assessment so substantially that its objectives and outcomes change drastically:

  • IBTE will endeavour to place you on an alternative program within IBTE, provided you meet its requirements;
  • if no suitable alternative exists, IBTE will recommend a comparable program at another reputable higher education institution.

Complaints procedure

9.1

Concerns are handled through the IBTE complaints procedure, designed to resolve matters promptly, fairly and amicably.

Informal resolution

  • Discuss the issue with the faculty member, department head or relevant staff first.
  • If it is not resolved, approach the Student Affairs Office for assistance and mediation.

Formal resolution

  • Submission. Complete a Complaint Application Form setting out the nature of the complaint, relevant dates, individuals involved and any evidence, and email it within 30 days to complaint@ibte.me and ceo@ibte.me.
  • Acknowledgment. The Student Affairs Office acknowledges receipt within 60 working days.
  • Investigation. A committee or designated individual investigates, may interview those involved and review documentation, and may invite you to a meeting. Confidentiality is maintained throughout.
  • Decision. You receive a written outcome with reasons and any resulting actions, within 120 days of submission.

Appeal process

  • You may appeal an outcome you are dissatisfied with, within 15 days of receiving the formal response.
  • A higher authority or independent committee reviews the appeal and confirms the final decision in writing.

External review

Escalating to external regulators or qualification providers after the internal appeal has consequences. The internal decision cannot be contested externally, and IBTE may terminate your admission and withhold certificates or transcripts for your current level of study. Actions that damage IBTE's reputation with third parties may be met with legal recourse, including compensation for damages or losses.

Record keeping

IBTE keeps a record of all formal complaints and their outcomes to ensure transparency and support continuous improvement.

9.2

All complaint communication must follow these clauses. Going directly to regulatory bodies, affiliates, partners or qualification providers instead is a material breach of this agreement, and IBTE may seek unlimited damages, take legal action for compensation, and terminate your admission while withholding transcripts or certificates.

9.3

complaint@ibte.me and ceo@ibte.me are the only official channels for complaints. Complaints sent elsewhere may not receive proper attention, and IBTE is not responsible for resulting miscommunication or delays.

Liability

10.1

IBTE is not liable for failing to perform obligations where the cause is beyond its reasonable control, including acts of God, war, terrorism, industrial disputes, pandemic, acts of government and new regulation, fire, flood, storm and national emergencies. In such a Force Majeure Event, IBTE will take all reasonable steps to minimise disruption to your studies.

10.2

IBTE is not liable for any failure to provide services caused directly or indirectly by industrial action or circumstances beyond its control.

10.3

Damage to IBTE property or to a residence, whether intentional or accidental, is charged to the students responsible. Students in residential accommodation are jointly and severally liable for shared facilities, and IBTE may recover costs for damage and exceptional cleaning.

10.4

You take full responsibility for any involvement in fraudulent events or cheating, including plagiarism, falsification of documents and academic dishonesty. IBTE may impose disciplinary action ranging from academic penalties to expulsion, and you bear the financial, legal and reputational consequences.

10.5

Academic integrity and prohibition of cheating:

  • You commit to the highest standards of academic integrity throughout your time at IBTE.
  • Cheating in any form is prohibited: using unauthorised materials or study aids, copying another student's work, having someone else complete a task on your behalf, unauthorised collaboration, and plagiarism.
  • Seeking help with academic tasks from any third party, inside or outside IBTE, is prohibited unless IBTE authorises it expressly.
  • Breach may bring penalties from failing grades to expulsion, withholding of certificates and transcripts, revocation of admission or a bar on further study, and legal, financial and reputational repercussions.
10.6

You must promptly report incidents or suspicions of cheating, by students or staff, to the appropriate institutional authorities, and cooperate fully with any investigation, including providing evidence or acting as a witness. Failing to report or cooperate may be treated as a breach of this agreement.

IBTE Right of Termination

11.1

IBTE may terminate your enrolment, at IBTE or at an affiliated overseas institution, if you consistently fail to meet your academic obligations to a degree that makes progression to the next phase improbable. As set out in clause 11.2, failure to matriculate ends this contract and deletes your student academic profile.

11.2

IBTE may bar your participation or entry at IBTE or affiliated overseas universities on grounds including disciplinary violations, failure to matriculate, outstanding tuition liabilities, poor attendance or unsatisfactory academic performance, following IBTE's established guidelines, policies and procedures.

11.3

IBTE may terminate this agreement at its sole discretion, for any reason and without your consent, provided it gives at least 30 days' written notice. Fees paid up to the date of termination are non-refundable, and the agreement is void after the notice period.

Qualification

12.1

Qualifications are provided by third-party qualification providers, such as NCC Education, which is regulated by Ofqual in the UK.

12.2

IBTE delivers qualifications in collaboration with third-party associates such as NCC, focused primarily on Level 3, Level 4 and Level 5 qualifications.

12.3

IBTE's courses and qualifications are not overseen by the Commission of Academic Accreditation or the UAE Ministry of Education. IBTE operates under the Knowledge and Human Development Authority (KHDA), and the qualifications it offers are regulated by Ofqual.

12.4

Direct questions to the relevant regulator: KHDA at web.khda.gov.ae/en/Contact-Us for IBTE's operations in the UAE, and Ofqual at public.enquiries@ofqual.gov.uk for the qualifications offered.

12.5

You confirm you are fully informed of how IBTE delivers qualifications, and agree not to claim ignorance of that method in order to lodge complaints intended to damage IBTE's reputation, extract refunds or otherwise act against IBTE's interests. Doing so is a direct violation of this agreement, and IBTE may initiate legal proceedings and seek compensation for damages or losses.

Prohibited activities

13.1

Non-compete with employees. For two years after your last engagement with IBTE you may not, directly or indirectly, work with current or former IBTE employees to replicate IBTE's business model or establish, promote or operate a competing entity. Breach is a material violation, and IBTE may seek legal remedies and compensation.

13.2

Non-solicitation of IBTE students. You may not contact or encourage other IBTE students to leave for another institution, or form groups or alliances aimed at that. IBTE may report such actions to the police, initiate a criminal case, pursue legal remedies and demand compensation for resulting damages.

13.3

No employment offers to IBTE personnel. You may not entice, solicit or offer employment to current or former IBTE employees, directly or through any entity you own, work for or are associated with. Breach is a material breach of this agreement.

13.4

Relationships with affiliates and partners. During your association with IBTE and for two years afterwards, you may not solicit or induce IBTE's employees, contractors or service providers to end their relationship with IBTE, or form ties with IBTE's clients, customers, suppliers or partners that divert business from IBTE or weaken those relationships.

13.5

Non-disparagement. During or after your association with IBTE, you may not make or assist any statement, in any medium, that is derogatory, defamatory or critical of IBTE, its programs, owners, directors, officers, affiliates, subsidiaries, employees, agents or representatives, or that discloses IBTE's confidential or proprietary information.

Intellectual Property Rights of IBTE Software and Portal

15.1

This clause governs rights in the IBTE software and portal, including source code, user interfaces, graphics, designs, algorithms, documentation, tools and processes.

  • Ownership. All rights remain the property of IBTE, spanning copyrights, patents, trademarks, trade secrets and other proprietary rights.
  • Licence. Users receive a limited, non-exclusive licence for the purposes stated in this agreement, with no right to modify, distribute or reverse-engineer.
  • Confidentiality. Users must prevent unauthorised dissemination, use or replication, and keep related proprietary information confidential.
  • Reporting. Suspected unauthorised use or breaches must be reported promptly, with cooperation in any resulting action.
  • End of agreement. Users must stop accessing the software and portal, delete stored digital copies, and confirm completion in writing.
  • Breach. IBTE may seek monetary compensation, injunctions and recovery of legal fees.
  • Longevity. This clause remains in effect after termination or expiry of the agreement.

IBTE Website Content Protection

16.1

All content on the IBTE website, from text and graphics to multimedia, is the exclusive intellectual property of IBTE, protected by copyright, trademark and other applicable laws. Visitors may access it for personal and informational needs:

  • Exclusive ownership. The Website Content belongs solely to IBTE and is protected by domestic and international intellectual property rights.
  • Permitted usage. A limited, non-exclusive right to access the content for personal informational purposes, with no commercial exploitation.
  • Restrictions. Unauthorised replication, modification or distribution is prohibited, including automated data extraction or collection tools.
  • Notices. Copyright, trademark and other proprietary markers must remain intact and unaltered.
  • Violations. Breaches can lead to legal action, including claims for damages, attorney fees and related costs.
  • Duty to report. Users must notify IBTE of potential unauthorised use and collaborate fully if IBTE contests a breach.

Trademarks

17.1

All IBTE trademarks, service marks, logos, trade names and branding, whether registered or unregistered, are the exclusive property of IBTE. You may not use or reproduce them without prior written consent, and all benefit derived from their use accrues to IBTE. You must not act in ways that diminish their value or reputation, must not challenge IBTE's ownership or registrations, and must inform IBTE of any known infringements. Unauthorised use may require you to indemnify IBTE against related damages, and IBTE may seek all available remedies, including injunctive relief. This clause persists indefinitely, even after any agreement between the parties ends.

Data Protection and Privacy

18.1

Data protection and privacy covers the policies and procedures IBTE uses to collect, store, process and share personal information securely. You grant IBTE authority on these terms:

  • Collection. IBTE may collect, store and process your personal data, including name, contact details, academic records and payment details.
  • Purpose. Data is used for academic, administrative, research and regulatory purposes, including course administration, billing, examinations and academic achievements.
  • Consent. By associating with IBTE you consent to this collection, processing, storage and use.
  • Security. IBTE applies industry-standard measures against unauthorised access, alteration, disclosure or destruction.
  • Third parties. Data may be shared with authorised third parties, regulators or affiliates where needed for operations or legal compliance, under comparable confidentiality terms.
  • Your rights. You may request access to, rectification of, or deletion of your data in writing, subject to legal or administrative reasons for retention.
  • Retention. Data is kept as long as necessary for these purposes, or as law and regulatory guidelines require.
  • Cookies. IBTE's digital platforms may use cookies or similar tracking for user experience, analytics and functionality.
  • Changes. This clause may be updated for legal, regulatory or operational reasons, with notice of significant changes.
  • Compliance. IBTE complies with the data protection and privacy laws of the jurisdictions in which it operates.

Usage of Likeness

19.1

By enrolling with IBTE you grant IBTE the irrevocable right to capture, use, reproduce and publish photographs, video footage and audio recordings featuring your image, likeness, voice or portrayal.

  • Purpose. Promotional, advertising, educational and operational use across IBTE's websites, publications, promotional materials, social media, news releases and other public communications.
  • No compensation. You are not entitled to payment, now or in future, for this use.
  • Waiver. You release IBTE, its agents, representatives, employees and authorised third parties from all claims, liabilities and demands arising from this use.

Confidentiality

19.2

During your association with IBTE you may be exposed to confidential, proprietary or privileged information belonging to IBTE or its affiliates, clients and partners, including business processes, strategies, marketing plans, customer lists, financial data, research findings, software, methodologies and trade secrets ("Confidential Information"). You agree to:

  • use it only for purposes related to your association with IBTE, never for personal gain or third-party benefit;
  • not disclose, reproduce or transmit any part of it to third parties without express written authorisation from IBTE;
  • return all materials containing it on request or when your association ends, and securely destroy information where IBTE asks, certifying that in writing;
  • limit access to those who need it for IBTE-related duties, and ensure they comply with these obligations;
  • notify IBTE immediately of unauthorised use, disclosure or breach, and assist in remedying it.

These obligations do not apply to information that becomes publicly available without breach of this agreement, that you can show you held beforehand, or that a third party provided without breaching a confidentiality obligation. They persist after your association with IBTE ends, and breach may lead to immediate remedial action and liability for damages or losses.

Official Communications

20.1

All official and binding communications from IBTE to a student or third party originate solely from ceo@ibte.me. Anything written, verbal or electronic that does not come from that address is not an official statement, commitment or representation of IBTE.

20.2

IBTE bears no responsibility for communications made through other email addresses, phone numbers or channels, even where they appear to be associated with IBTE. Verifying the authenticity of any communication is your responsibility.

20.3

You agree not to rely on or act upon communications from sources other than the official address. WhatsApp, alternative email addresses, phone calls and social media platforms are not official exchanges between you and IBTE.

General provisions

Severability

If a provision of this agreement is found invalid, unlawful or unenforceable, it is severed to that extent and the remaining provisions stand. Both parties will work in good faith to agree a valid replacement that achieves the original intent and economic effect as closely as possible.

Assignment

You may not assign, delegate or transfer any of your rights, obligations or interests under this agreement without IBTE's prior written consent; any unauthorised transfer is null and void. IBTE may assign its rights and obligations at its sole discretion.

Waiver

A failure or delay in exercising a right or provision is not a waiver of it. No single waiver is continuing, and waiving one breach or default does not waive any later breach or default. Rights not expressly waived remain in full effect.

Indemnification

You indemnify, defend and hold harmless IBTE, its directors, officers, employees, agents and affiliates against all liabilities, losses, damages, claims, penalties, fines, costs and legal fees arising directly or indirectly from your breach of any term, condition, representation or warranty in this agreement. This obligation survives the end of your association with IBTE and the termination of this agreement.

Limitation of Liability

To the fullest extent permitted by law, IBTE's liability for any claim arising out of or in relation to this agreement, whether in contract, negligence, strict liability or otherwise, will not exceed AED 2,000. IBTE is not liable for indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, data, goodwill or business interruption. Where you breach the agreement, IBTE may claim unlimited liability reflecting dispute handling, reputational damage, operational and administrative costs and disruption to its services or programs.

Survival

Provisions that by their nature are intended to survive termination, cancellation or expiry remain in full force, including confidentiality, non-compete, non-solicitation, return of property and remedies for breach, until the obligations are fully satisfied.

Acknowledgement

You confirm that you have read, understood and agree to all terms and conditions in this agreement, that you had the opportunity to seek independent legal counsel, and that you are entering into it voluntarily, without duress or undue influence. Violating these terms may carry significant legal consequences.

Governing Law and Jurisdiction

In any dispute arising out of this contract, the parties submit to the jurisdiction of the courts of Dubai.

Duration of Agreement

This agreement takes effect on your registration with IBTE or on signing these terms, and continues throughout your time at IBTE. Its terms extend for five years beyond completion of your studies, or until IBTE terminates it, whichever comes first.

Exclusive Agreement and Enforceability

This contract binds only you and IBTE. It is the entire and definitive agreement between the parties, superseding all prior written or verbal understandings.
